This help in the development of the nation. Further, we will discuss about foreign direct investment (FDI) by the NRI in detail in this blog.<\/span><\/p>\n<h2 style=\"text-align: justify;\"><b>Who is an NRI?<\/b><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">NRI stands for Non-Resident Indian .Any person who is residing outside India or holding OCI (Overseas Citizen of India) card is refer to as an NRI.NRI is defined under <\/span><span style=\"font-weight: 400;\">The Foreign Exchange Management Act,1999<\/span><span style=\"font-weight: 400;\"> and <\/span><span style=\"font-weight: 400;\">Income Tax Act, 1961<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">For instances, if any person from India moves to Canada for studying. However, later became a permanent resident there is refer as a NRI. However, India doesn\u2019t allow dual citizenship.<\/span><\/p>\n<h2 style=\"text-align: justify;\"><b>What are the different types of Foreign Direct Investment NRI\u2019s can do?<\/b><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">There are two types of investment NRI\u2019s can do i.e.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Repatriation basis \u2013 The provisions of <\/span><span style=\"font-weight: 400;\">Foreign Exchange Management (Mode of Payment and Reporting of Non-Debt Instruments) Regulations, 2019<\/span><span style=\"font-weight: 400;\">\u00a0is necessary to amend timely and govern FDI by NRI on Repatriation basis.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Non \u2013 Repatriation basis &#8211; The provisions of Foreign Exchange Management Regulations, 2019\u00a0put forward in schedule 4 of the act. This schedule 4 governs FDI by NRI on Non-Repatriation basis.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><b>Registration Regulations<\/b><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Any investment in India made by a person residing outside India must comply with the following rules.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Any Indian firm that offers common shares to a group of residents anywhere outside India meanwhile that offer is review as Foreign Investment. However, Receipts of FDI i.e. money received from FDI to any <\/span><span style=\"font-weight: 400;\">Company<\/span><span style=\"font-weight: 400;\"> from subscribing to shares of any company<\/span><b>.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Within 30 days company must report about FDI received.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Within 180days of receiving money companies must a lot shares.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Generally, regulations clearly states and disclose the issue. Resident sellers \/ buyers are responsible for reporting.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Transfers of &#8220;Participating rights&#8221; in the oil field must be reported on Form FCTRS.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The form FCTRS shall be filed within sixty days of transfer of equity instruments or receipt\/remittance of funds whichever is earlier.<\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><b>Schedule 3<\/b><\/h3>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">&#8220;Return-based investment&#8221; refers to an investment whose maturity income (after tax) is subject to return from India.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Payment Methods i.e. relevant amounts shall be reimburse from international remittances via banking channels. Further, from funds held in Non- Resident Account (NRE) maintained in accordance with the law {<\/span><span style=\"font-weight: 400;\">Foreign Exchange Management (Deposit) Regulation 2016<\/span><span style=\"font-weight: 400;\">}.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Further, the <a href=\"https:\/\/www.cagmc.com\/nre-and-nro-accounts\/\">NRE account<\/a> (PIS) account is the specific account is in use only to make the transactions permissible in this schedule.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Net of taxes of equity instrument may be t outside India or in NRE account to a specific person.<\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><b>Schedule 4<\/b><\/h3>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Investment by NRI and OCI Card holder on non-repatriation basis<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is refer as a domestic financing and FC-GPR form is necessary to submit.<\/span><\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Amount of consideration is reimbursed overseas through special overseas banking channel.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sum of money subsidize in any business enterprise.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Its allowance to any <\/span><a href=\"https:\/\/www.cagmc.com\/llp-registration\/\"><span style=\"font-weight: 400;\">LLP<\/span><\/a><span style=\"font-weight: 400;\"> is no longer authorized to be repatriated overseas.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><b>Conclusion<\/b><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">FDI by NRI are necessary as it help to grow foreign reserves of a nationand its help to contribute to the Gross Domestic Product.
