Society is a legal form and is governed by the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Societies_Registration_Act,_1860#:~:text=The%20Indian%20Societies%20Registration%20Act,literary%2C%20scientific%20and%20charitable%20societies.&amp;text=The%20memorandum%20of%20association%20has,with%20the%20Registrar%20of%20Societies.\" target=\"_blank\" rel=\"noopener\">Societies Registration Act, 1860<\/a>. Such MOA is required to be filed with Registrar of Joint-stock companies.<\/p>\n<h3 style=\"font-size: 20px !important; color: #1e82b6;\"><strong>\u00a0<\/strong><strong>Procedure to form a society:<\/strong><\/h3>\n<ol>\n<li>Name selection and its approval from registrar:<\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"text-align: justify;\">It is necessary that while selecting a name for <a href=\"https:\/\/www.cagmc.com\/society-registration-in-rajasthan\/\">society registration<\/a>, it should be according to Society Act, 1860 i.e., an identical or similar name of a currently registered society will not be allowed.<\/li>\n<li style=\"text-align: justify;\">The proposed name should also not suggest for any patronage of state government or government of India or fascinate the provisions of Emblem &amp; Names Act, 1950.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ol start=\"2\">\n<li>Preparation of MOA:<\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>MOA is a charter of Society. It contains the following clauses:<\/li>\n<li>Name clause<\/li>\n<li>Object clause<\/li>\n<li>Registered office clause<\/li>\n<li>Governing Body Member clause<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ol start=\"3\">\n<li>Preparation of rules and regulation (by-laws):<\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Rules and regulations contains the following clauses:<\/li>\n<li>Membership clause<\/li>\n<li>Meeting clause<\/li>\n<li>Governing Body Member clause<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ol start=\"4\">\n<li>Other documents:<\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>This also requires the following documents:<\/li>\n<li>Copy of resolution for Registration of Society<\/li>\n<li>Copy of resolution Authorizing a person to make application for registration<\/li>\n<li>List of members of Society along with their address<\/li>\n<li>Rent Agreement or Registered Paper<\/li>\n<li>NOC from Land Lord<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ol start=\"5\">\n<li>Submission of documents for registration:<\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"text-align: justify;\">MOA along with rules and regulations to be filed with respective Registrar of Society.<\/li>\n<li id=\"post\" style=\"text-align: justify;\">Copy of rules and regulations of Society should be certified by at least 3 members of the governing body of the Society. After being satisfied, the Registrar approve the application and grant Certificate to the Applicant.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3 style=\"font-size: 20px !important; color: #1e82b6;\"><strong>Post compliances:<\/strong><\/h3>\n<ul>\n<li style=\"text-align: justify;\">Post compliances vary from state to state. However, there are some general compliances to be done. These are as follows:<\/li>\n<li style=\"text-align: justify;\">Hold Board Meeting of Society every year.<\/li>\n<li style=\"text-align: justify;\">Hold AGM every year.<\/li>\n<li style=\"text-align: justify;\">Once in every year, within 14 days of AGM, a list of members shall be filed with the Registrar of Society.<\/li>\n<li style=\"text-align: justify;\">Maintain proper accounts of Society.<\/li>\n<li style=\"text-align: justify;\">Maintain minutes of board meeting and general meeting of society.<\/li>\n<li style=\"text-align: justify;\">Filing of ITR.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Content What is society?
