time in following circumstances:<\/li>\n<\/ul>\n<ol style=\"text-align: justify;\">\n<li style=\"list-style-type: none;\">\n<ol>\n<li>The business has:<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ul style=\"text-align: justify;\">\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Discontinued,<\/li>\n<li>Transfer fully for any reason including death of proprietor,<\/li>\n<li>Amalgamated with other entity or,<\/li>\n<li>Demerger or<\/li>\n<li>Otherwise disposed of.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ol style=\"text-align: justify;\">\n<li style=\"list-style-type: none;\">\n<ol start=\"2\">\n<li>There is any change in constitutions of the business.<\/li>\n<li>The taxable person, other than person registered u\/s 25(3) is no longer to be registered u\/s 22 or 24.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ul style=\"text-align: justify;\">\n<li>Proper officer may cancel the registrations of person from such date, including any retrospective date, as he may deem fit where:<\/li>\n<\/ul>\n<ol style=\"text-align: justify;\">\n<li style=\"list-style-type: none;\">\n<ol>\n<li>A registered person has contravened such provision of Act or Rules made there under<\/li>\n<li>A person paying tax u\/s 10 has not furnished returns of three consecutive tax periods.<\/li>\n<li>Any registered person (other than (b) above) has not furnished returns for a continuous period of 6 months.<\/li>\n<li>Any person who has taken voluntary registrations under section 25(3) has not commenced business within 6 months from date of registrations.<\/li>\n<li>A registration has been obtained by means of Fraud, wilful, misstatement or suppression of facts.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ul style=\"text-align: justify;\">\n<li>The cancellations of registrations shall not affect the liability of person to pay tax &amp; other dues under this Act or to discharge any obligations under this act or rules made there under for any period prior to the date of cancellations.<\/li>\n<li>The cancellations of registrations under SGST\/UTGST shall be deemed to be cancellations of registrations under CGST.<\/li>\n<li id=\"provision\">A registration person whose registrations are cancelled will have to debit to the <a href=\"https:\/\/www.cagmc.com\/electronic-ledger-under-gst\/\">electronic credit or cash ledger<\/a> by an amount equal to:<\/li>\n<li>ITC in respect of stock of inputs and inputs contained in semi-finished\/ finished goods stock or capital goods or plant &amp; machinery on the day immediately preceding the date of cancellations or<\/li>\n<li>The output tax payable on such goods<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Whichever is higher, calculated in such a manner as may be prescribed.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Provision<\/strong><\/h3>\n<p style=\"text-align: justify;\">In case of capital goods or plant and machinery, the taxable person shall pay on account:<\/p>\n<ul id=\"from\" style=\"text-align: justify;\">\n<li>Equal to ITC on said capital goods or Plant &amp; machinery, reduced by such % points as may be prescribed<\/li>\n<\/ul>\n<p style=\"text-align: center;\">Or<\/p>\n<ul style=\"text-align: justify;\">\n<li>Tax on transactions value of such capital goods u\/s 15<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Whichever is higher.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Form for cancellation under GST laws:<\/strong><\/h3>\n<ul style=\"text-align: justify;\">\n<li>Cancellation by a registered individual- Form GST REG 16<\/li>\n<li>Issue show cause notice for Cancellation- Form GST REG 17<\/li>\n<li id=\"revocation\">Reply to show cause notice- Form GST REG 18<\/li>\n<li>Order for dissolution- Form GST REG 19<\/li>\n<li>To stop the cancellation proceedings- Form GST REG 20<\/li>\n<li>Explanation form to stay proceedings- Form GST REG 18<\/li>\n<li>Application for revoking the cancellation- Form GST REG 21<\/li>\n<li>Order revoking the cancellation- Form GST REG 22<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><strong>Revocation of cancellation of registrations (section 30):<\/strong><\/h3>\n<ul style=\"text-align: justify;\">\n<li>What is Revocation of cancellation of registrations (section 30)?<br \/>\nRevocation of cancellation of registrations means that the decision of cancelling the registration has been reversed and registration is still valid.<\/li>\n<li>When Revocation of cancellation of registration is applicable (section 30)?<br \/>\nThis is applicable only in the case when the tax officer has cancelled the registration of a taxable person on his own motion.
