In case of cash gift- fully taxable, in case of gift in kind- fully taxable when value of gift exceeds \u20b950000.<\/li>\n<li>Immovable property (inadequate consideration): If consideration is less than the stamp duty value of the property and the difference between the stamp duty value and consideration is more than the higher of-\n<ol style=\"text-align: justify;\">\n<li>\u20b950000 and<\/li>\n<li>5% of consideration<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<p id=\"exceptions\" style=\"text-align: justify; padding-left: 40px;\">Then the difference between the stamp duty value and consideration shall be chargeable to tax in the hands of the assessee as \u201cIncome from other sources\u201d.<\/p>\n<ul style=\"text-align: justify;\">\n<li>The Section 56(2) (x) would apply only to the specified property which is in the nature of a capital asset of the recipient and not stock- in \u2013 trade, raw material or consumable stores of any business of the recipient.<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><strong>Exceptions to Section 56(2) (x):<\/strong><\/h3>\n<p style=\"text-align: justify;\">This section does not apply to following if any sum of money or any property received:<\/p>\n<ul style=\"text-align: justify;\">\n<li>From any relative<\/li>\n<li>On the occasion of marriage of individual<\/li>\n<li>Under a will or by way of inheritance<\/li>\n<li>In contemplation of death of the payer or donor, as the case maybe<\/li>\n<li id=\"words\">From any local authority as defined in the explanation to section 10(20)<\/li>\n<li>By any fund or trust or institution or any university or other educational institution or any hospital or other medical institution referred to in section 10(23C)(iv)\/(v)\/(vi)\/(via).<\/li>\n<li>Amalgamations, Successions, Demerger which is not a transfer under section 47.<\/li>\n<li>From or by any trust or institution registered under section 12AA<\/li>\n<li>From an individual by a trust created or established solely for the benefit of relative of the individual.<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><strong>Key words:<\/strong><\/h3>\n<ul style=\"text-align: justify;\">\n<li>Property:<\/li>\n<\/ul>\n<p style=\"text-align: justify; padding-left: 40px;\">A capital asset of the assesse, namely:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul style=\"text-align: justify;\">\n<li>Immovable property being land or building or both,<\/li>\n<li>Shares and securities<\/li>\n<li>Jewellery<\/li>\n<li>Archaeological collections<\/li>\n<li>Drawings<\/li>\n<li>Paintings<\/li>\n<li>Sculptures<\/li>\n<li>Any work of art or bullion<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li>Relative:<\/li>\n<\/ul>\n<p style=\"text-align: justify; padding-left: 40px;\">In case of an individual:<\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol style=\"text-align: justify;\">\n<li>Spouse of the individual<\/li>\n<li>Brother or sister of the individual<\/li>\n<li>Brother or sister of the spouse of the individual<\/li>\n<li>Brother or sister of either of the parents of the individual<\/li>\n<li>Any lineal ascendant or descendant of the individual<\/li>\n<li>Any lineal ascendant or descendant of the spouse of the individual<\/li>\n<li>Spouse of any of the persons referred to above.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">In case of Hindu Undivided Family, any member therof.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Table of Content What is Section 56(2) (x) of Income Tax Act, 1961?
